These Terms of Service explain the intended terms for access to and use of the Akeye website and software platform. Akeye is currently a project in an early commercial and product validation phase and is not yet presented here as a registered legal entity.
Before Akeye is offered under a formal company, paid subscription or signed commercial agreement, these terms may be replaced or supplemented by a formal agreement, order form or company-specific legal terms.
1. About Akeye
Akeye is a B2B software platform intended for organizations such as companies, clubs, associations, sports organizations, facilities and service providers. It helps organizations manage units, people, users, roles, activities, reservations, tasks, communication, operational records and related workflows.
Akeye is not intended for public self-registration by end users. User accounts are normally created or invited by the organization using the platform.
2. Access and use
Access to Akeye may be provided for testing, demo, pilot, early access or commercial validation purposes. By accessing or using Akeye on behalf of an organization, you confirm that you are authorized to do so and that the organization is responsible for its use of the platform.
Akeye may change, limit, suspend or discontinue access during the early phase, especially for maintenance, security, misuse prevention or product changes.
3. Organization responsibilities
The organization using Akeye is responsible for:
- using the platform lawfully;
- ensuring that all data entered into Akeye is accurate and lawful;
- informing individuals whose data is entered into Akeye;
- having a valid legal basis for processing personal data;
- managing users, roles and permissions;
- keeping login credentials secure;
- ensuring that only authorized persons access the platform;
- complying with any applicable employment, membership, sport, health, consumer, data protection or other laws.
4. User accounts
User accounts are created or invited by the organization. Akeye does not provide public self-registration for end users. The organization is responsible for activity under its organization account and user accounts, except where caused by Akeye's own technical fault or misuse.
Akeye may suspend or restrict access if an account appears compromised, unlawful, harmful or risky to the service or other users.
5. Customer data
Data entered into Akeye by an organization remains the responsibility of that organization. Akeye does not claim ownership of customer data.
The organization grants Akeye the limited right to host, store, process, transmit, secure and display customer data only as needed to provide, maintain, support and improve the platform.
6. Data protection
Where Akeye processes personal data entered by an organization, the organization is normally the data controller and Akeye acts as a data processor.
The organization is responsible for informing its users, members, staff, customers, athletes, guests, tenants, guardians and other individuals about the processing of their personal data in Akeye.
A separate Data Processing Agreement may apply when Akeye is used commercially or under a formal agreement.
7. Acceptable use
You must not use Akeye to:
- violate laws or rights of others;
- upload malware, harmful code or illegal content;
- attempt unauthorized access;
- interfere with the security or availability of the platform;
- send spam or unlawful communications;
- reverse engineer or copy the platform except where allowed by law;
- enter data that the organization has no lawful right to process.
8. Early access and availability
During the early phase, Akeye may be provided as a demo, pilot, beta or validation service. Features may change, be incomplete or be removed. Availability is not guaranteed unless agreed separately in writing.
Akeye will use reasonable efforts to keep the platform secure and available, but interruptions may occur due to maintenance, updates, provider issues or technical problems.
9. Fees and payment
Any fees, payment terms, pilot terms or commercial conditions must be agreed separately in writing, by offer, invoice, order form or another confirmed arrangement.
If no separate commercial agreement exists, access may be considered demo, pilot or early access and may be limited or terminated.
10. Third-party services
Akeye may rely on third-party providers for hosting, infrastructure, email delivery, DNS, security, monitoring, development, analytics, payment or similar services. Akeye is not responsible for third-party services outside its reasonable control.
11. Intellectual property
All rights in the Akeye platform, software, design, workflows, documentation, brand and related materials remain with the Akeye project owners or licensors.
Organizations and users receive only a limited, non-exclusive, non-transferable right to use the platform for the agreed or permitted purpose.
Feedback, suggestions or ideas may be used to improve Akeye without obligation, provided that confidential customer data is not disclosed.
12. Confidentiality
Both Akeye and the organization should protect confidential information received through the use, testing or evaluation of the platform and use it only for the intended purpose.
13. Disclaimer
Akeye is provided on an "as is" and "as available" basis, especially during the early phase. To the maximum extent permitted by law, no guarantee is made that the platform will be uninterrupted, error-free or suitable for every specific use case.
The organization is responsible for evaluating whether Akeye meets its operational, legal and technical requirements.
14. Limitation of liability
To the maximum extent permitted by law, Akeye is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profit, revenue, goodwill or data.
Any liability will be limited according to the written agreement with the organization. If no written commercial agreement exists, liability is limited to the maximum extent permitted by applicable law.
15. Termination
Access may be terminated by the organization or by Akeye. After termination, customer data may be exported, deleted or retained for a limited period depending on technical feasibility, backup cycles, legal requirements and any separate agreement.
16. Changes
These Terms may be updated as the Akeye project, platform, company structure, providers or legal requirements change. The latest version will be published on akeye.app.
